These Terms and Conditions (hereafter "Terms") govern access to and use of the MyHomeHearth site (hereafter "the Site"), published by Sly Software Services ([legal form / registration number to be completed], [address to be completed]), an online personal and household assistant platform. By creating an account and using the Site, the user (hereafter "the User") accepts these Terms without reservation.
The Site allows the User to: organize a virtual garden with automatic plant placement based on companion planting; maintain a contacts directory, including contacts tagged "medical"; write notes and recipes; plan meals from those recipes; keep a personal calendar (events, meals, medical appointments); manage fresh and packaged product stock, with automatic shopping-list generation; receive reminders by e-mail and, on opt-in, SMS; and access personal music and video libraries. Services are available free of charge during a trial period, after which an active paid subscription is required.
Two plans are offered: a monthly subscription and an annual subscription, whose exact prices and currency are displayed on the subscription page at the time of signup. Payment is processed securely via PayPal. The subscription renews automatically at each term (monthly or annual) unless cancelled beforehand by the User from the "My Account" page.
Accessing the Site requires an Internet connection and suitable equipment. Costs related to these remain the User's responsibility. MyHomeHearth undertakes to use all reasonable means to ensure continuous access to the service, without however guaranteeing permanent availability.
To access the Site's features, the User must create a personal account. The User undertakes to provide accurate information and to keep their login credentials confidential. Any fraudulent or unauthorized use of the account is the User's responsibility.
A User may create or join a "household" grouping several accounts. In that case, the Garden, Stock, Shopping and Calendar modules become visible and editable by all household members. The Contacts, Notes and Recipes modules always remain strictly personal and are never shared, even within a household. A User may leave a household at any time from the "My Account" page.
The User may enable, module by module, e-mail and/or SMS notifications (the latter requiring a phone number). These notifications can be disabled at any time from the "My Account" page. Enabling them constitutes the User's consent to receive these communications; disabling them withdraws that consent without affecting the rest of the service.
The Site collects and processes certain personal data of the User, including, where applicable, health data resulting from tagging a contact or appointment as "medical" (a special category of data under Article 9 of the GDPR). A separate document describes how this data is collected, processed and protected: Privacy Policy.
All elements of the Site (text, images, graphics, logos, videos, software, etc.) are protected by intellectual property law. Any reproduction, representation, modification, publication or adaptation of all or part of the Site's elements, by any means or process, is prohibited without prior written authorization. Music and video files uploaded by the User to their personal libraries remain their exclusive property; the User warrants holding the necessary rights over any content they upload.
MyHomeHearth provides tools to help with personal and household organization, but cannot be held liable for the accuracy, completeness or currency of information entered by the User, nor for plant placement, crop rotation or meal planning suggestions, which remain purely indicative. MyHomeHearth is in no way a medical service: features related to "medical" contacts or appointments are simple organizational tools and do not substitute for medical advice, follow-up or consultation. The Site cannot be held liable for losses, damages or disputes related to the use of information it provides or that the User enters into it.
The User may cancel their subscription and/or delete their account at any time from the "My Account" page. Deleting the account results in the immediate and irreversible erasure of all associated data (contacts, notes, recipes, garden, stock, music and video files). Any amount already paid remains due to the publisher, subject to the right of withdrawal exercised within the legal timeframe (14 days after signup).
MyHomeHearth reserves the right to modify these Terms at any time. Changes take effect as soon as they are published online. The User will be informed by e-mail or via a notification on the Site.
These Terms are governed by French law. In the event of a dispute, an amicable settlement will be sought before any legal action. Failing that, the competent courts shall be those of the publisher's registered office.
